1. Agreement to these Terms

By downloading, installing, or using the Astuto mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the App.

These Terms form a legally binding agreement between you and Astuto Ltd, a company incorporated in England and Wales, company number 17263058, with its registered office at 66 Paul Street, London, England, United Kingdom, EC2A 4NA ("Astuto", "we", "us", "our").

2. Eligibility

2.1 Age requirement

You must be at least 16 years old to use the App. You must be at least 18 years old to participate in prize competitions or claim prizes.

2.2 Geographic eligibility

The App is available to residents of the United Kingdom, United States of America, Australia, and Mexico. Prizes are available to residents of the countries listed in the Prize Rules (the United Kingdom at launch).

Prizes are not available to residents of New York, Florida, or Rhode Island; users in those states may play but cannot win prizes until Astuto completes registration there.

2.3 Prohibited users

The following persons may not use the App:

• Persons under 16 years old (and, for prize competitions, persons under 18 years old)
• Persons prohibited from using the App under the laws of their jurisdiction
• Employees, contractors, or immediate family members of Astuto Ltd
• Persons previously banned from the App by us

3. Your account

3.1 Registration

Astuto does not require email registration. Your account is identified by a randomly generated anonymous device identifier. You choose a display name during onboarding.

3.2 One account per person

You may only operate one account per person. Creating multiple accounts to gain a competitive advantage, circumvent a ban, or manipulate prize eligibility is a material breach of these Terms.

3.3 Your display name

Your display name must not impersonate another person, contain offensive content, include personal contact information, or infringe any intellectual property right.

3.4 Account security

If you lose access to your device, contact us at support@astuto.gg. We will assist where reasonably possible but cannot guarantee account recovery.

3.5 Account deletion

You may request deletion of your account at any time by contacting privacy@astuto.gg.

4. The quiz service

4.1 Daily quiz

The App provides one daily quiz of five multiple-choice questions. Each daily competition runs on a 24-hour cycle with a short nightly maintenance window during which entries are closed.

The daily cut-off is 23:30 London time, applied globally, so that all players worldwide are ranked against the same daily boundary. Winners are determined shortly afterwards, at 00:00 London time; for convenience, that moment is shown in each user's local time (for example, 19:00 US Eastern the same evening).

4.2 One attempt per day

You may play the daily quiz once per day only. There are no replays, retries, or second attempts regardless of technical issues after you have begun a session.

4.3 Questions and content

In the event of a disputed question, Astuto's decision on the correct answer is final. We will not adjust individual scores based on disputes unless a clear factual error affected all players simultaneously.

4.4 Service availability

We aim to make the App available 24 hours a day but do not guarantee uninterrupted access. Streak shields (§5.4) may automatically protect your streak across a missed day.

5. Scoring and lifelines

5.1 Server-authoritative scoring

All scoring is calculated and stored on Astuto's servers. The server's calculation is the definitive record. Any discrepancy between your device and the server is resolved in favour of the server.

Astuto provides two in-game lifelines. Neither can be purchased with money.

Reveals. A reveal greys out two incorrect options on the Final Question (Q5) before you answer. New accounts begin with two reveals. You earn one reveal for each perfect (5/5) quiz and one for every seven days played. Using a reveal reduces your raw daily score by 100 points (your score cannot fall below zero). Reveals affect only your own daily score.

Streak shields. New accounts begin with one streak shield, and you can hold at most seven at any time. A streak shield automatically protects your streak if you miss a day. Shields are applied automatically overnight — you never trigger them manually. If you miss a day and hold a shield, your streak and your reveal progress are preserved and one shield is consumed. If you miss a day with no shield, a streak of seven days or more steps down (it does not fully reset), and a streak under seven days resets to zero; in both cases your reveal progress also resets to zero.

Streak shields are earned by watching rewarded ads (offered only while you hold fewer than seven), a one-time email link, and referral milestones. No grant takes you above seven.

6. Prizes and competitions

6.1 Nature of the competition

Astuto prize competitions are skill-based competitions, not lotteries or games of chance. Winners are determined by quiz performance (knowledge and speed), not by random draw. This is fundamental to compliance with UK gambling law, US sweepstakes law, and Australian trade-promotion rules.

6.2 Free entry — no purchase necessary

Entry to prize competitions is always free, and a free entry path always exists. No payment is required to enter, play, or win.

6.3 Eligibility for prizes

• At least 18 years old
• Resident of a country listed in the Prize Rules as open for prizes (the United Kingdom at launch)
• Not resident in a currently excluded US state (New York, Florida, Rhode Island)
• Accurate, self-declared birth year provided during onboarding
• A valid email address, provided on the claim form before the claim deadline
• Not a current or recent director, officer, owner, employee or contractor of Astuto Ltd, or an immediate family member of one

6.4 How winners are determined

The daily competition for each country closes at 23:30 London time. Winners are determined at 00:00 London time (19:00 US Eastern / 07:00 AEST the following morning). The three eligible participants with the highest scores on each country's leaderboard on that date win that day's prizes; where scores are equal, the faster completion time ranks higher.

Monthly prizes: cumulative leaderboard rank, including the streak multiplier, at month end.

6.5 Prize claim process

Winners are notified in the app, by push notification and, where we hold an email address for you, by email. You must claim your prize in the app by 23:59 UK time on the 14th calendar day after the day you are notified. Prizes not claimed by then are forfeited.

6.6 Prize delivery

Prizes are issued as Amazon gift cards delivered digitally to your registered email address within 5 working days of confirmed eligibility. Confirmed winners are placed in a dispatch queue; issuance may be automated or processed manually.

6.7 Prize limits and jurisdiction rules

6.8 Tax

Prize recipients are solely responsible for any tax obligations in their jurisdiction. Astuto does not withhold tax on prizes unless required by law. Paying taxes is your responsibility, and Astuto offers no liabilities, warranties, or any other responsibility for your taxes in any way.

6.9 Disqualification

We reserve the right to disqualify any player and withhold any prize where we have evidence of cheating, false eligibility information, or where applicable law requires us to do so. Disqualification decisions are final.

6.10 Sponsor

Astuto Ltd (company number 17263058, 66 Paul Street, London, England, EC2A 4NA) is the sole sponsor and promoter of every Astuto prize competition. Apple Inc. and Google LLC are not sponsors of, and are not involved in, any Astuto competition or prize in any way. Questions or complaints about a competition should be sent to Astuto at support@astuto.gg.

7. In-app purchases — Astuto Plus

7.1 Astuto Plus subscription

Astuto Plus is an optional, auto-renewing subscription available on monthly and annual terms. Plus removes interstitial advertising and does not affect quiz scores, rankings, shields or prizes.

7.2 Billing, renewal and cancellation

Astuto Plus is sold and processed by the Apple App Store (iOS) or Google Play Store (Android) as merchant of record, subject to their terms. The subscription renews automatically at the end of each period unless you cancel at least 24 hours before the period ends. You can manage or cancel your subscription at any time in your App Store or Google Play account settings; cancellation takes effect at the end of the current billing period.

7.3 Refunds and statutory rights

Refund requests must be directed to Apple or Google through their standard refund processes; Astuto cannot process refunds directly. Your statutory consumer rights (including, where applicable, UK and Australian cancellation and consumer-guarantee rights) are not affected.

7.4 Rewarded ads

You may choose to watch rewarded advertisements to earn Streak Shields, without payment.

7.5 Parental consent and responsibility for purchases

If you are under 18, you may use the App and make in-app purchases only with the consent and under the supervision of a parent or legal guardian. All in-app purchases are processed by the Apple App Store or Google Play Store using the account and payment method registered on the device.

The account holder and the person responsible for that payment method (the "bill payer") is responsible for keeping the device, store account, and payment credentials secure, for supervising any person they allow to use the device, and for purchases authorised through the device's payment authentication — including purchases made by a minor using the device.

We strongly encourage bill payers to enable the parental controls provided by Apple (such as Ask to Buy and Screen Time) and Google Play (such as purchase authentication and Family Library) to prevent unintended purchases.

Because Apple and Google act as merchant of record, refund requests — including where a bill payer believes a purchase was made by a minor without authorisation — must be made to Apple or Google under their refund policies. Astuto cannot process or guarantee refunds directly. Nothing in this section affects your statutory rights as a consumer, or any remedy available where a purchase was genuinely unauthorised.

8. Advertising

The free version of Astuto shows interstitial ads between parts of the quiz, served by Google AdMob. You can also choose to watch rewarded ads, for example to earn a streak shield. Astuto Plus removes interstitial ads; rewarded ads stay available if you choose to watch them. Advertising personalisation is subject to your consent choices as described in our Privacy Policy (opt-in in the UK; opt-out in the USA and Australia). Users who indicate they are under 18 are served only non-personalised (contextual) advertising.

9. Acceptable use and fair play

You agree not to:

• Use automated tools, scripts, bots, or macros to play or manipulate scores
• Exploit bugs or glitches for unfair advantage
• Share quiz questions or answers during the active daily quiz window
• Create multiple accounts
• Impersonate another user, an Astuto employee, or any other person
• Reverse-engineer, decompile, or extract source code from the App
• Interfere with the App's servers, infrastructure, or other users' experience
• Use the App for any commercial purpose without our written consent
• Attempt to circumvent any security or anti-fraud measures
• Use the App in violation of applicable laws

10. Intellectual property

All App content — quiz questions, scoring systems, interface design, graphics, the Astuto name, and logo — is owned by or licensed to Astuto Ltd and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial use only.

11. Third-party services

The App integrates Google AdMob, RevenueCat, Amazon Web Services and Firebase. These services are governed by their own terms and privacy policies. We are not responsible for third-party acts or omissions.

12. Disclaimers

The App is provided "as is" and "as available" without warranty of any kind. We do not guarantee that quiz questions are accurate, complete, or current, nor that access will be continuous or uninterrupted. Astuto's determination of correct answers is final for scoring purposes.

13. Limitation of liability

Astuto will not be liable for: loss of profits, revenue, or anticipated savings; loss or corruption of data; or indirect, consequential, or punitive damages.

Our total liability is limited to the greater of (a) the amount you have paid us in the 2 (two) months before the claim, or (b) £100.

Nothing limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law. Statutory consumer rights in the UK and Australia are not affected.

14. Indemnification

You agree to indemnify and hold harmless Astuto Ltd and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses arising from: your use of the App; your breach of these Terms; your violation of third-party rights; or any content you submit.

15. Termination

You may stop using the App at any time. Contact privacy@astuto.gg for full account deletion.

We may suspend or terminate your access immediately, without notice, if you breach these Terms, if we are required to by law, or if we discontinue the App. Provisions that by nature should survive termination will do so.

16. Updates to these Terms

These Terms are versioned by date: 2026-10-08. For material changes, we will show a notice in the App. Continuing to use the App after the change means you accept the updated Terms. For non-material changes (typos, contact updates) we may update without a notice.

17. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except: Scotland and Northern Ireland consumers may use their local courts; and Australian Consumer Law applies and cannot be excluded.

17.1 US dispute resolution

For US residents, unresolved disputes may be submitted to binding arbitration under JAMS rules. You waive the right to participate in class-action lawsuits or class-wide arbitration. This does not apply to individual small-claims-court matters or claims for injunctive relief.

18. General provisions

Entire agreement: these Terms, together with our Privacy Policy and the Prize Competition Rules (Section 6), constitute the entire agreement between you and Astuto regarding your use of the App.

Severability: if any provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue in full force.

No waiver: failure to enforce any right is not a waiver.

Assignment: you may not assign your rights without our consent.

Force majeure: Astuto will not be liable for failure or delay caused by circumstances beyond our reasonable control.
